Moloney Solicitors are leading a consumer class action claiming damages on behalf of affected consumers who purchased vehicles with defeat devices in their diesel engines. Volkswagen has already publicly admitted that they installed defeat devices in their diesel engine software and in some countries have already settled consumer lawsuits from affected vehicle owners.
Commenting on consumers rights to take legal action Liam Moloney Solicitor said today “the time limit for pursuing these claims in Ireland is normally six years from the date that consumers became aware that their vehicles contained these defeat devices. Consumers were notified that their vehicles contained these “defeat devices” in 2015 so these claims will soon become time-barred so it is very important that any consumer who has been notified should immediately arrange for legal proceedings to be issued to protect their legal position.
Mr Moloney continued “our clients are seeking the following remedies from the Courts for the breach of contract of VW and their agents :
- Damages
- Replacement of their vehicles
- Re-purchase of the vehicle at its value before the defeat device became known
- Damages for a reduction in the value of the vehicle
- Repairs/replacement of exhaust systems
