Johnson & Johnson has just settled another one of the nearly 11,000 lawsuits it is facing in the USA over its now recalled DePuy Orthopaedic ASR metal-on-metal hip implant.
This particular case which was filed in the New Jersey Superior Court had been scheduled for dismissal as the Court had received notice from both sides in the litigation that the matter had been resolved between the parties.
Last month Johnson & Johnson agreed to settle a case that was part of a multi-district litigation (MDL) organised in California. The settlement occurred days before the case was to reach a jury.
Other legal actions remain in New Jersey and Ohio. Meanwhile DePuy face more legal actions from patients over its metal-on-metal implant under the Pinnacle brand.
The food and drug administration in the USA issued a January 2013 safety alert concerning metal-on-metal hip implants indicating that as a class the devices had failed. Most metal-on-metal hip device implants have been recalled and are the focus of major litigation throughout the world. Thousands of patients in Ireland received metal-on-metal hip devices and many have issued proceedings against their manufacturers and suppliers.
