Yvon McCarthy a 28 year old mother of 2 young children who sustained significant injuries in a road accident in December 2008 in Ashbourne Co Meath has been awarded €170,000 in damages by the High Court.
Ms McCarthy suffered injuries to her head, knee, eye, neck and lower back in the accident. She also missed a considerable period of time off work as a result of her injuries.
Ms McCarthy suffered from psychological trauma after the accident and was prescribed Lexapro and sleeping medication. Ms McCarthy’s on-going complaints from the time of the accident in December 2008 to the date of hearing of her case included knee pain and discomfort especially when she was going up and down stairs. Ms McCarthy had made a good recovery with regard to her other injuries. The soft tissue injury to her neck abated within a few weeks but her back pain continued for some considerable period of time.
Ms McCarthy returned to part-time work in May 2013 and experienced a lot of pain in her knee when she returned home from work and when she had to attend to a range of domestic duties.
Judge Irvine in the High Court awarded Ms McCarthy €85,000 for general damages to date, €15,000 in respect of general damages for pain and suffering into the future, €60,000 in respect of past loss of earnings and €10,000 in respect of other items of out of pocket expenses making a total award of €170,000.
