Liam Moloney, Principal Solicitor of Moloney & Company Solicitors, Naas, Co.Kildare an expert in personal injury law has called upon the Government to establish a no-fault compensation scheme to compensate people injured due to the failure by Local Authorities to grit roads and footpaths in their areas of responsibilities.
Mr Moloney commented
“Section 60(1) of the Civil Liability Act 1961 which provides that a Road Authority shall be liable for damage caused as a result of their failure to adequately maintain a public road has not yet been signed into Law. Refusal by this present Government and previous Governments to give proper and full legal effect to this provision may mean that hundreds of people who have been injured in trips and falls on public roads may not receive compensation”.
In equity a scheme should be established with immediate effect to properly compensate all those people who have sustained significant losses as a result of their injuries. In many cases people have incurred expensive medical bills, loss of earnings and trauma through accidents which were caused through no fault of their own and given the slow response by local authorities in dealing with the crisis the Government should ensure that these victims are compensated.
