Moloney & Co. Solicitors are experts in dealing with personal injury* compensation claims for people injured in public places.
The most common types of accidents in public places we deal with are public liability claims arising from slips, trips, and falls in public places, accidents in schools and in retail premises and accidents abroad.
What is a Public Liability Claim?
If you have an accident or suffer a personal injury* whilst on public property which was not your fault then you may be entitled to make a personal injury compensation claim.
The person or company owning and/or responsible for maintaining the public area should have taken out public liability insurance cover to compensate members of the public for any injury they sustain whilst on the property caused by their negligence, therefore your personal injury* claim for compensation would be made against that insurance policy.
Types of Public Claims
- Injuries caused by dangerous footpaths, potholes, dangerous steps of staircases.
- Slips, trips and falls in supermarkets, shopping centres, car parks and restaurants.
- Injuries caused by sharp objects or objects falling from a height in public places.
- Litter and rubbish bags creating tripping hazards in walking areas or badly parked vehicles on the road which may obstruct the foot path.
It you have suffered an injury after being involved in an accident in a public place contact us now and we will be able to let you know if you are entitled to make a public liability compensation claim.
What should I do now that I have had an accident in a public place?
- To make a successful public liability compensation claim you would need to prove that another person was responsible for your personal injury* (in this case the owner of the property where your accident happened).
- To help your case you should report the accident to the staff or owner at the time, make a note of your accident in the accident book if possible, take names and addresses of witnesses to the accident and if possible take photographs of the area where the accident took place.
- If you are intending to claim expenses as part of your public liability compensation claim such as loss of earning or medical expenses remember to keep receipts as evidence.
Remember, there are strict time limits to make an injury claim. In Ireland the statute of limitation is two years and therefore all cases must be commenced within two years from the date of the accident or you will be stopped from taking the case under Irish law.
