The Package Holiday and Trade Act 1995 applies to package holidays offered for sale or sold in the Irish State and provides protection to consumers while on a package holiday.
In order to come within the meaning of the 1995 Act the holiday must come within the definition of a package. If the accident involves a motor vehicle in the European Union then the proceedings can be brought here in Ireland under the provisions of EU Law.
If the proceedings are instituted here in Ireland, an Irish Court must have regard to how damages are assessed in the Country where the accident occurred itself.

This Law Firm can also assist in getting Police Reports, medical records and reports.
It is important that any person injured in an accident abroad reports the accident immediately, be it to a hotel or police, and also retains a copy of the Accident Report Form and name of the police who investigated the accident. It is also necessary to get insurance details from any parties involved in an accident.
