Patients who received defective ASR metal- on- metal hip implant devices (MoM). These clients are now achieving settlements of their High Court Personal Injury Actions. The ASR hip device was intended to avoid wear problems associated with traditional implants.
The use of metal on metal hip implants has now been practically abandoned. The proportion of metal-on-metal resurfacing implants has decreased from a peak in 2006 to account for only 1% of implants in 2014.
The types of adverse reactions to metal debris encompass the following:-
- Metallosis (deposition of metal particles)
- Pseudotumor (fluid or solid cystic mass)
- ALVAL (Aseptic Lymphocytic Vasculitis and associated Lesions)
Moloney Solicitors have issued High Court proceedings against DePuy International Limited claiming damages against the manufacturers for the sale and supply of these defective medical products. The main defect associated with the ASR device is its propensity to cause adverse reactions to metal debris. Some of the design defects in the ASR device have caused femoral neck fractures, loosening of the device and infections.
STEPS TO TAKE IF YOU ARE HAVING PROBLEMS WITH YOUR METAL-ON-METAL HIP IMPLANT DEVICE
If you have been provided with a metal-on-metal hip implant device and your blood ion levels are raised (7ppb or higher) then you should immediately arrange to undergo an ultrasound or an MRI scan. You may also have to have histology investigations carried out by your Doctors. You should also be referred to an Orthopaedic Surgeon who can advise you in relation to your options and revision surgery may be required which involves significant surgery.
Under the EC Product Liability Directive you have 3 years from the time you became aware of the “defect, damage and the identity of the producer” to commence legal action against the manufacturer or supplier of the device.
