Letitia Malkmus, a Wisconsin resident suffered injuries from a Defective hip implant manufactured by DePuy Orthopaedics Inc. She and her husband filed a lawsuit against DePuy and PRP & Associates, a Wisconsin based distributor of the implant.
DePuy, who manufacture and distribute hip implants failed to show that she had fraudulently joined DePuy as a party to the litigation, a US Court has heard.
The distributor argued that the Plaintiff could not recover under strict liability rules against them, as it was not a “seller” of the artificial hip under Wisconsin law. The Court rejected that argument.
