Holiday makers are entitled to expect that the holiday they booked and paid for complies with the description given to them when they purchased it.
The new Package Travel Regulations came into force on the 1st of July 2018. Under these new regulations, more holiday travel arrangements will be classified as packages. This means that holiday makers are entitled to a refund or to be brought home if their travel company goes into liquidation or ceases trading.
The travel company will also be responsible for ensuring that the holiday maker gets the package holiday they paid for. Also, if something isn’t provided that should have been the travel company or the third party supplier will have to resolve the issue whether this means offering alternative accommodation or providing a full or partial refund.
What information should my travel company give me at the time of my booking?
When you book a package holiday, you are entering into a contract with the business. Therefore the information given to you in the holiday brochure must not be false or misleading in anyway.
The written copy of the contract that you receive before you travel should contain the following information;
- Cost of the package holiday
- The destination and duration of the holiday
- The type of transport involved and the departure times
- Any taxes or compulsory charges
- Passport & visa requirements
- Travel insurance requirements
- Cancellation arrangements for the organiser and the consumer.
Unfortunately thousands of holiday makers each year leave Ireland without the benefit of travel insurance and therefore in many cases the only level of protection that they have if something goes wrong on their holidays is to pursue a claim either against the tour operator or the accommodation provider.
