Insurance companies are continuing to fight compensation claims from road traffic injury victims when the repair costs to their vehicle are less than €1000.
While there is no scientific basis for Insurance Companies to refuse to compensate genuine injury victims when material damage repair costs are less than €1000 insurance companies continue to fight these cases on the basis that no injury could be sustained in a minimum impact collision.
Personal injury Solicitor Liam Moloney uses biomechanical analysis which information can be decisive in establishing the injury mechanism associated with a road traffic accident.
It is important to have an understanding of the forces that occur within the body when someone is involved in a road traffic accident. Issues such as whether somebody is braced for an impact, whether they are wearing a safety belt or not and their positioning in the vehicle itself can contribute to the extent of the injury they receive as a result of a low-velocity impact.
It is important that people who are genuinely injured in road traffic accidents are properly compensated for their injuries and are not frightened off from pursuing their right to claim compensation even if the damage to the vehicle costs less than €1000 to repair. In many cases, Judges accept that people can suffer no injury where the damage to the vehicle is severe but, in many cases, where there is not a substantial amount of material damage injuries can still occur.
